Important Notice
Vision Improvement Plan (VIP) is a subscription-based vision care service. VIP is not insurance and does not provide insurance coverage. VIP is not a licensed insurance product, health plan, or qualified health benefit. VIP provides access to eye care services at participating providers through a monthly subscription.
These Terms of Service ("Terms") govern your use of the Vision Improvement Plan website at visionimprovementplan.com and your participation in the Vision Improvement Plan subscription service ("Service"). By using our website or subscribing to our Service, you agree to be bound by these Terms.
1. About Our Service
Vision Improvement Plan is a subscription-based vision care service that provides subscribers with access to comprehensive eye exams, glasses, and contact lenses at participating eye care providers. VIP is not insurance. By subscribing to VIP, you are purchasing a subscription for discounted vision care services, not an insurance policy.
VIP does not guarantee the availability of any specific provider, and providers may join or leave our network at any time. We will make reasonable efforts to maintain provider availability in your area.
2. Subscription Terms
Enrollment
To subscribe to VIP, you must complete our enrollment process and provide accurate, complete information. You must be at least 18 years old to enroll. Parents or legal guardians may enroll dependents.
Subscription Term
All VIP memberships (Eye Health Exam, Exam + Glasses, Exam + Glasses + Contact Lens, Multifocal Exam + Glasses) are twelve-month subscriptions. We offer annual subscriptions billed either monthly or yearly. By enrolling, you are committing to a twelve-month subscription term.
Billing
Charges will be applied automatically to the payment method used for the first payment. If you choose monthly billing, payments will be charged on the same calendar day each month, and the account holder is responsible for all twelve monthly payments for the subscription term. If you choose annual billing, the full annual amount is charged at the time of enrollment and on each renewal. You are responsible for ensuring your payment method is valid and current. Current pricing is listed on our website. We reserve the right to modify pricing with advance notice to subscribers.
Automatic Renewal
Memberships will automatically renew for an additional twelve-month period unless a written cancellation request is submitted to Vision Improvement Plan via email at viptx.info@gmail.com. The account holder must submit this request at least twenty-four (24) hours in advance of the calendar day that the subscription is scheduled to renew.
Cancellation
Cancellation requests must be submitted in writing via email to viptx.info@gmail.com. The following cancellation terms apply:
- Services not yet rendered: If the plan's services have not been rendered, the member may cancel without any fee or responsibility of fulfilling the agreement.
- Services already rendered: If the plan's services have been rendered and the account holder wishes to cancel, the account holder must pay the remaining monthly payments at the time of cancellation.
Refund Policy
There are no refunds. Sign-up fees and monthly subscription payments are non-refundable.
3. Services and Providers
VIP services are available only at participating providers within our network. Services included in your subscription are determined by your selected plan and may include:
- Comprehensive eye examinations
- Dilation or retinal imaging
- Glasses prescriptions and select frames and lenses
- Contact lens fittings and prescriptions (with applicable addon)
Services beyond what is included in your plan may be available at additional cost. Participating providers are independent practitioners and are not employees or agents of Vision Improvement Plan. We do not practice medicine or provide medical advice.
4. Use of Website
You agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorized access to our systems or data
- Submit false or misleading information through our forms
- Interfere with or disrupt the website or its servers
- Reproduce, distribute, or modify website content without our written permission
5. Limitation of Liability
To the fullest extent permitted by Texas law, Vision Improvement Plan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services. Our total liability for any claim arising from your subscription shall not exceed the total amount of subscription fees you have paid in the twelve (12) months preceding the claim.
6. Disclaimer of Warranties
Our website and services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components. We do not guarantee specific clinical outcomes from services received through participating providers.
7. Indemnification
You agree to indemnify and hold harmless Vision Improvement Plan, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of our services.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.
9. Changes to These Terms
We reserve the right to update these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
